Drafting Pleading and Conveyancing - Sample Assignment Questions


CLININAL COURSE –III- DRAFTING , PLEADING AND CONVEYANCING ASSIGNMENT
5th semester of 3yr course LL.B.(Karnataka State Law University) - A total of 30 such questions will be asked for your assignment. 

PART-1 DRAFTING OF PLEADINGS

1.Mr.Prakash ,a resident of Bangalore entered into an agreement with Smt. Rashmi who is a resident of mysore to purchase a 30”x40” site situated in mysore by giving a token amount of 20 lakh on 20th September 2010. The above agreement was registered. In that agreement they entered a clause saying that if a sale deed is not executed with in the said period by the seller, the registered agreement will be treated as a sale deed and the purchaser can take the possession. On 20th sep 2011 Mr. Prakash went and asked for execution of sale deed from Smt. Rashmi ,who refused to execute the same. Ramesh filed case. Draft a plaint for this case.

2.Mr. Jayaraj. who is a trader in supply of rice to whole sale shops. He entered into a contract with Bhimmanna who is a whole sale shop owner to supply 100 bags of rice to him everyday. Jayaraj took token money from Bhimmanna as a consideration. The contract was signed in Belgum on 24/8/2009. After few days that Jayraj told that he can not supply the good to Bimmanna for consideration which he had accepted and he demanded more amount from the buyer. Bhimanna filed a case against Jayaraj. Draft a written statement.

3.Draft an interlocutory application requesting for granting of temporary injunction. in a declaratory suit between Prafulla and Nagesh with respect to a house property situated at No.36, 25th cross Rajajinagar,Bangalore.

4. Dharmesh and Vydehi are married according the hindu ceremonies and registered their marriage in Hubli in the year 1999. After few years the marriage fell on rocks. Both husband and wife decide to take divorce. They filed a petition for divorce by mutual consent. Draft a matrimonial case petition.

5.Draft an affidavit in a maintenance case filed under Hindu Adoption and maintenance Act1956 between Harsha and Sumathi residing in Bombay.

6.Sheela had lent 90.000 rupees to Mr. Rajesh on 1/2/2008 by creating a security on Rajesh house property which is worth of 1crore . Rajesh fails to pay a debt amount. Sheela filed a suit and the decree was passed in her favour. Being a decree holder she wants to file a execution petition before the court. Draft an execution petition.

7.Rahul ,a resident of Delhi, everyday he use to go for a morning walk in a park which is full of green tress . The residents of whole Delhi use to come to the same park . Suddenly the government authorities passed an order saying that the park will be converted into a hospital because there is no government hospital for the poor residents in the locality. Challenging the order of the government authority Rahul filed a writ petition before the court in Delhi. Draft a writ petition under article 226 of Constitution of India.

8.Smt.Bhagya resident of Hydrabad had purchased a 37” of LED tv by paying 2lakhs from JJ.Home appliances in Bangalore along with warranty card for 1year on 22/12/2010. She brought that to Hydrabad but the tv was not functioning properly. When she gave complaint about the same to the shop owner , he did not responded properly. She filed a consumer complaint before district consumer redressed forum in Hydrabad requesting for compensation amount of 3 lakhs. The forum granted only 2 lakhs. She filed an appeal before the state forum . Draft an memorandum of appeal in above case.

9.Mr.Krishna married Narmada according to hindu rituals but there were no issues for them. After a few years of their marriage that is in the year December 2008 Krishna adopted a son from a orphan home with out the consent of his wife Narmada. She file a case of challenging the validity of adoption by Krishna. Draft a petition for Narmada. 

10.Mr. Girish met with an accident on the road in Kolkotta because of the negligent driving by Mr.Jack in the year 2010. In the accident he lose his right leg. He filed a case before the MVC tribunal which awarded a compensation amount of 50.000 rupees. He filed a appeal before the higher court challenging that the compensation awarded by the tribunal is not sufficient. Draft a memorandum of appeal.

11.Amith ,residing in kolkotta member of a joint family. Along with him Surya, Banu and Ajith are also the members of joint family . They have 7 acres of agricultural land in same vicinity. In 2010 they divided the agricultural land among themselves on the basis of oral partition, but they failed to enforce the same. After 2yrs Amith asked the other members to execute a separate partition deed which was denied by them. They said that they divide the property according to the old partition but Amith did not accept this. He filed a partition suit in court. Court decreed the suit saying that a now partition deed must be executed. The defendants filed a revision petition against the order of the lower court. Draft a revision petition.

12. Drithi wife of Ramesh resident of Mangalore lodged a FIR against Ramesh alleging that he has harassed her for more dowry. He subjected her to cruelty. Police framed charge sheet under section 498A of IPC. Draft a criminal complaint.

13.Shruthi married to Sagar and were residing in Madras he was in illicit relation ship with a married women. Shruthi got to know this. She filed criminal complaint against her Sagar. Police officers arrested him and produce before the magistrate. He filed a bail application before the magistrate requesting to grant the same. Draft a bail application.

14. Bharathi married to Santhosh and they were residing in Madras he was in illicit relationship with a married women. Bharathi got to know this. She filed criminal complaint against her husband. Before the police could arrest him he filed a bail application to prevent his arrest. Draft an anticipatory bail application.

15.Mr.Kumar filed a complaint against Rahul under section 138 of Negotiable instrument Act before Judicial magistrate court in Mysore. Draft a complaint .


Note: 1.Students are required to draft the above assignment in white executive bond sheets in one side and it should be hand written.

    I am a student of 5th sem. Please anyone can guide me with these DPC assignments.In my college attendance is not compulsory and so i hardly know anyone there for any kind of reference..Please Please help me in this.
